By downloading, installing, or using the Chotty iOS keyboard application (the "App"), you confirm that you are in agreement with and bound by these Terms & Conditions. These Terms apply to the App and any communication between you and Chotty.

Chotty is developed and maintained by an individual developer based in Barcelona, Spain ("we," "us," or "our"). If you do not agree to these Terms, please do not use the App.

1. Definitions and Key Terms

For clarity, the following terms are used throughout these Terms & Conditions:

  • Cookie: small amount of data generated by a website and saved by your web browser, used to identify your browser or remember preferences.
  • Company: when these Terms mention "Company," "we," "us," or "our," it refers to the individual developer behind Chotty, based in Barcelona, Spain.
  • Device: any internet-connected device such as a phone or tablet used to access the App.
  • App/Application: the Chotty iOS keyboard application.
  • Third-Party Service: refers to OpenAI and any other providers used to deliver AI-powered features within the App.
  • You: a person who installs and uses the Chotty App.

2. License to Use

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on any Apple device you own or control, strictly in accordance with these Terms and Apple's App Store Terms of Service.

This license is for personal, non-commercial use only. We reserve the right to revoke this license at any time if you violate these Terms.

3. Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, or otherwise commercially exploit the App
  • Modify, create derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App
  • Remove, alter, or obscure any proprietary notices or labels on the App
  • Use the App to generate spam, phishing content, or any illegal or harmful material
  • Attempt to bypass or circumvent any AI safety filters or content moderation systems
  • Automate requests to the App in a way that exceeds normal human usage patterns
  • Use the App in any way that violates applicable local, national, or international law

We reserve the right to suspend or terminate your access without notice if we determine, at our sole discretion, that you have violated any of these restrictions.

4. Subscriptions and Billing

Chotty offers paid subscription plans processed exclusively through Apple's in-app purchase system.

Free Trial

  • New users receive a 7-day free trial before being charged
  • The trial automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends
  • You will not be charged during the trial period

Paid Plans

  • Monthly subscription: billed once per month
  • Annual subscription: billed once per year (typically offered at a discount)
  • Prices are displayed in the App at the time of purchase and may vary by region

Auto-Renewal

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged within 24 hours prior to the end of the current subscription period
  • You can manage and cancel your subscription at any time in your Apple ID Account Settings

We reserve the right to change subscription prices at any time. Price changes will be communicated in advance through the App or App Store page.

5. Refunds

All purchases are processed by Apple through the App Store. We do not handle billing directly and cannot issue refunds ourselves. Refund requests must be submitted to Apple at reportaproblem.apple.com. Apple's refund policies apply.

If you are not satisfied with the App, please contact us and we will do our best to address your concerns.

6. AI-Powered Features

The App uses OpenAI's API to provide AI-powered features including quick answers, translation, and writing assistance. By using these features, you acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or unexpected output
  • You are solely responsible for reviewing and verifying any AI-generated content before use
  • We do not guarantee the accuracy, completeness, or appropriateness of AI responses
  • Text you submit for processing is sent to OpenAI's servers in accordance with our Privacy Policy

7. Your Suggestions

Any feedback, comments, ideas, or suggestions (collectively, "Suggestions") you provide to us with respect to the App shall become the sole and exclusive property of Chotty. We shall be free to use, copy, modify, publish, or redistribute your Suggestions for any purpose without any credit or compensation to you.

8. Intellectual Property

The App and its entire contents, features, and functionality — including all software, text, design, and branding — are owned by us and protected by applicable intellectual property laws of Spain and international treaties. Unauthorized use of any materials is prohibited.

You retain ownership of content you create using the App. By submitting text to AI features, you grant us a limited, temporary license to process that text solely to deliver the requested feature.

9. Copyright Infringement Notice

If you believe any material in the App infringes your copyright, please contact us with the following information:

  • Your physical or electronic signature
  • Identification of the copyrighted work and the allegedly infringing material
  • Your contact information (address, phone number, and email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement that the information provided is accurate and that you are authorized to act on behalf of the copyright owner

10. Third-Party Services

The App relies on third-party services including OpenAI (for AI features) and Apple's App Store (for distribution and billing). We are not responsible for the availability, accuracy, or practices of these services. Your use of such services is governed by their respective terms and policies.

11. Modifications to the App

We reserve the right to modify, suspend, or discontinue — temporarily or permanently — the App or any feature within the App, with or without notice and without liability to you. We may from time to time provide updates, bug fixes, or enhancements. You agree that we have no obligation to provide any updates or to continue providing any particular feature or functionality.

12. Term and Termination

These Terms remain in effect until terminated by you or by us. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate reason.

You may stop using the App at any time. To cancel your subscription, you must do so through your Apple ID Account Settings — uninstalling the App alone does not cancel your subscription.

Upon termination, your license to use the App ceases immediately. Termination does not limit any of our rights or remedies at law or in equity.

13. Disclaimer of Warranties

THE APP IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI features are provided as-is and may produce unexpected results.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

15. Indemnification

You agree to indemnify, defend, and hold harmless Chotty and its developer, officers, agents, and licensors from any claim, demand, loss, or expense — including reasonable legal fees — arising out of: (a) your use of the App; (b) your violation of these Terms or any applicable law; or (c) your violation of any third-party rights.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision will be modified to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chotty regarding your use of the App.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain and the European Union, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If unresolved within 60 days, disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

If you are a consumer in the EU, you may also be entitled to remedies under mandatory consumer protection laws in your country of residence, which these Terms do not override.

18. Apple's Role

These Terms are between you and us, not with Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. In the event of any App failure to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

Apple is a third-party beneficiary of these Terms and may enforce them against you as a third-party beneficiary.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via the App or App Store page before new terms take effect. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree, you may stop using the App.
